Every Member Requesting Private Sailing Lessons Acknowledges Reading and Agreeing to these Terms & Conditions 

Terms and Conditions for Private Sailing Lessons

Members agree to abide by the rules, regulations, and policies of the Nyack Boat Club regarding Private Sailing Lessons through the club. 

Acknowledgment of Risk

Members who participate int the Club's program of Private Sailing Lessons knowingly, willingly, and voluntarily acknowledge the inherent risks associated with such participation, that such participation involves risks and dangers including, without limitation, the potential for serious bodily injury (including broken bones, head or neck injuries), sickness and disease (including communicable diseases), trauma, pain & suffering, permanent disability, paralysis and death; loss of or damage to personal property; exposure to extreme conditions and circumstances; accidents involving other boaters; contact or collision with natural or manmade objects; adverse weather conditions; facilities issues and premises conditions; failure of protective equipment; inadequate safety measures; situations beyond the immediate control of the Club; and other undefined, not readily foreseeable and presently unknown risks and dangers (Risks). 

Assumption of Risk

Members understand that the aforementioned Risks may be caused in whole or in part or result directly or indirectly from the negligence of their own actions or inactions, the actions or inactions of sailing instructors, the actions or inactions of others, and voluntarily and knowingly assume all such Risks and responsibility for any damages, liabilities, losses, or expenses that they incur as a result of their use of Club-owned boats for Private Sailing Lessons.  Members who use Club-owned boats for their Private Sailing Lessons agree to indemnify and hold harmless the Nyack Boat Club against any and all claims for damage (whether personal injury or otherwise) arising from  their use of any of the boats owned by the Nyack Boat Club.  Members further agree that they are responsible for any damages that they cause to any such boat or its equipment.

Who May Request Private Sailing Lessons

  1. Only adult (over age 21) Regular Members and Seasonal Members of Nyack Boat Club (Members) may request and pay for Private Sailing Lessons.  Regular Members include Active, Senior, Provisional and Life members of Nyack Boat Club.  Seasonal members include Special Activity Members. 
  2. Private Sailing Lessons are only one-on-one: one instructor and one member-student. 

Terms for Private Sailing Lesson Requests

  1. Private Sailing Lessons (Lessons) are provided by Club-designated instructors.  Instructors use Club-owned Ideal 18 sailboats for the lessons. 
  2. Member must use the Clubs online booking system to make a PrivateSailing Lesson request (Request).   
  3. At the time a member makes a Request, the member must pay for the lesson.  
  4. Lessons are availble based on instructor and boat availability, which may vary. 
  5. Once an instructor has scheduled a specific Lesson time with a member, the member may only reschedule with 24-hour notice.  If the member cancels within the 24-hours before the Lesson time, then the Lesson fee is forfeit 
  6. Instructors may reschedule Lessons at any time and for any reason. 
  7. Lesson times are measured from meeting at the Club dock until returning to the Club dock, and the Lesson includes transit to the boat, rigging, sailing de-rigging, and transit to the dock. 
  8. Upon meeting at the dock for a Lesson, the instructor may determine that the Lesson should be rescheduled for any reason, inlcuding weather and sea conditions. 
  9. Members participating in Lessons must supply their own PFD (life jacked) and wear it throughout the lesson.
